1. Content of our services

1. Content of our services

We act solely as intermediaries for all services related to the health trips we arrange and do not offer these, unless expressly stated otherwise, in our own name or on our own account.

Our service exclusively comprises the mediation of transport and organizational services such as flight bookings, hotel reservations, and appointment scheduling with the respective clinic. The execution of the respective services is not part of our contractual obligations. We have no influence over this. This particularly applies to all medical services, including but not limited to, the operation, related medical pre- and post-treatments, as well as any other medical ancillary services. The sole contractual partner is the respective clinic or the respective doctor.

2. Conclusion of the agreement

By transmitting the patient information (in writing, by fax, or by email) to us, you make a legally binding offer to the respective service provider and simultaneously authorize us with the mediation service. You will then receive a booking confirmation from us, which merely confirms the receipt of the order. The contract between you and the respective service provider (e.g., clinic, airline) only comes into effect once either the service provider or we, on behalf of the service provider, confirm the requested services to you.

As far as we are to mediate various services with different service providers for you, this does not result in a travel contract with us, even if the individual services are summarized on a common invoice. We are not a tour operator. You are aware that the division of services among different service providers may also bring disadvantages, among others, because no service provider can be regarded as a tour operator in terms of travel contract law, and therefore you will not receive a security certificate from the service providers for the total services or for individual services. In the event of potentially poor performance by a service provider, for example, the basis for calculating a reduction is only the individual owed service, but not the total costs, which could reduce the claims in terms of amount.

3. Information

Information about the services provided is based exclusively on the information from the service providers towards us. Our information does not constitute any guarantee or assurance regarding accuracy,

completeness, and timeliness. All information provided by us relates to the time of the information being given.

We are liable for the careful selection of the information source and the correct reproduction of the information and advice provided to you, in the context of statutory provisions.

We will inform you about the identity of the operating airline for all transportation services on the outbound and return flights before the conclusion of the contract, provided that the airline is already determined before the conclusion of the contract. In this regard, we refer to the information in the respective service description regarding the airlines used. If the airline is not yet determined, we will inform you before the conclusion of the contract about the airline that is expected to operate the flight. As soon as the airline is confirmed, we will ensure that you receive this information as quickly as possible. This also applies to any changes concerning the airlines operating the flight service, provided that we are informed by the airline.

4. Withdrawal from the health trip

Of course, you can cancel the intended health trip at any time. However, in this case, you must pay us a cancellation fee (see No. 5).

As far as flights, hotels, or clinic services have already been booked, we would like to point out that further costs may arise from the service providers, the amount of which we have no influence over.

Please inform us in the event of the intended cancellation as soon as possible in writing or by email.

5. Cancellation costs for our services

For our mediation activities, we do not charge you any costs for the execution of the treatment. Nevertheless, we do have costs. Particularly because we regularly work with partners (clinics, hotels, but also companies for the transfer to and from the airport) on site, they rely on the fact that the patients we mediate also show up and keep corresponding capacities available.

If you wish to postpone or no longer utilize the various services we mediate – for whatever reasons – we will therefore charge you cancellation costs of €250 for your booked treatment trip. If you later (within 12 months) take the same health trip with us, we will credit or refund the cancellation costs. These costs will occur as soon as we have booked the treatment at the partner clinic on your behalf.

If you do not show up for the trip without informing us, we unfortunately have to charge increased cancellation costs of €600. In this case, all services will be reserved locally for you, without us being able to inform the service providers that you are no longer going to take the trip on short notice. However, you are, of course, allowed to prove that we incur no or a significantly lower loss than the cancellation costs mentioned in this section.

If you cannot fly during this pandemic period due to “Covid Test Positive”, the trip will be completely rebooked to a different agreed date free of charge. However, if you must cancel because you do not know when you will fly again, the aforementioned cancellation costs will be charged to you; which will be credited to the OP costs on site in Istanbul within a year.

6. Liability

The legal provisions apply. However, the provision of services (flight travel, medical services, etc.) is not one of our obligations. In particular, the decision regarding the type of medical treatment is made solely by you. Therefore, we are not liable for any improper service provision, especially any treatment errors by the respective service provider.

7. Further obligations of the customer during transport (especially flight)

Please note that the terms and conditions of the respective service providers named in the service description may establish special obligations.

In particular, it is important to pay attention to information in flight tickets, such as reminders regarding check-in times as well as, particularly for special and charter flights, the obligation to have outbound, return, and onward flights re-confirmed by the airline within a time frame specified by them. Failure to comply with such obligations may result in the loss of your right to transportation without entitlement to (partial) reimbursement of the travel price. In cases of luggage loss or damage, immediate notification to the airline is required by national and international regulations. Without this, you risk losing your claims for compensation.

8. Entry requirements for Turkey

Please note that you must comply with the applicable entry and exit regulations for Turkey.

Currently, German citizens can travel to Turkey with their identity card. If you need a visa, you can apply for it at the following link: www.evisa.gov.tr

9. Jurisdiction

If you a) are a merchant within the meaning of the HGB or b) do not have a general place of jurisdiction in the country or c) are sued by us and relocate your residence or habitual place of abode outside the scope of the German Code of Civil Procedure after the conclusion of the contract, the place of jurisdiction is agreed to be Rastatt.

10. Online dispute resolution / Consumer Arbitration Board:

The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr/.
We are not willing and obliged to participate in dispute resolution proceedings before a consumer arbitration board.
